By browsing and purchasing items from this website you are automatically agreeing to the terms and conditions of the site as set out below. Suitability of use

AP Fitzpatrick Fine Art Materials supply products and raw materials that are intended for professional use. It is the customers’ responsibility to ensure that goods purchased are suitable for their particular requirements, that any health and safety guidelines relating to the use of materials are followed and that the goods are received in an acceptable condition. 

Some of the materials we supply are of a hazardous nature. When these items are ordered, AP Fitzpatrick reserves the right to contact customers to discuss the order in more detail, at which point we may be able to suggest alternatives as necessary. We reserve the right to refuse to supply certain products or materials listed on the AP Fitzpatrick website.

Many of the products supplied by AP Fitzpatrick are made from substances of natural origin, whose behaviour can vary from batch to batch, in different environments and according to the way in which they are utilised. AP Fitzpatrick cannot be held responsible for any adverse effects caused to artworks or persons from the use of any of our products. AP Fitzpatrick’s liability is confined to the value of goods alone where they are deemed faulty. We will not entertain claims for the value of artworks alleged to have been adversely affected by the use of any product supplied by us.

We take utmost care to wrap and pack goods for dispatch to minimise risk of damage to products in transit. Care must always be taken when opening parcels (particularly in the unlikely event goods have been damaged in transit) so as to avoid spillage, damage to goods and/or damage to other property (i.e. clothing, soft-furnishings etc.). Damage caused by carelessness when opening parcels will not be compensated for by AP Fitzpatrick Fine Art Materials.

Order Processing

By placing an order online, a contract is created between the customer and AP Fitzpatrick. The steps required in creating this contract are as follows:

    •    You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the order process by a series of simple instructions on the Website.

    •    We will send you an order acknowledgement email detailing the products you have ordered.

    •    The contract between you and us is completed upon the despatch to you of the Products ordered, unless we have notified you that we do not accept your order, or you have changed or cancelled the order by contacting us within 24 hours of placing the order.

Non-acceptance of an order may be a result of one of the following:

    •    The product you ordered being unavailable from stock.

    •    If we are unable to obtain authorisation for your payment.

    •    A pricing or product description error is identified in your order.

    •    You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

All correspondence throughout the order process will be conducted in English.

Credit/Debit Card Payment

We accept the following credit and debit cards as payment: Visa, Visa Electron, MasterCard, Maestro, American Express and JCB.

AP Fitzpatrick Fine Art Materials will take payment at the time the order is placed online including for any items on back order, unless the option to pay by telephone order is selected . Payment is processed on dispatch for orders submitted by telephone, email or by post. 

If you are shopping from outside of the UK, place your order and your credit card company will convert the transaction to your own currency. All transactions will be charged in pounds sterling and will be converted at the then current applicable exchange rate by your credit card company.

Paying by Cheque

If you wish to pay by cheque, please select the option to pay by telephone order, then confirm you will be sending a cheque by email or by calling us. Please make the cheque out to AP Fitzpatrick Fine Art Materials. The processing time will be delayed by however long it takes for the cheque to reach us and the order will not be dispatched until the cheque has cleared.

Refund Policy

Justifiable returns must be notified to us within 7 days of receiving your order.

If you wish to make a return, please contact us before returning goods.

Credit notes or refunds can be issued for the justified return of goods purchased from AP Fitzpatrick Fine Art Materials, provided they are accompanied by the original invoice and are returned in a saleable condition within 28 days of the receipt of your order. 

The return of such items including cost of postage is the full responsibility of the customer, and the goods must be securely packaged to ensure that they arrive back to us undamaged.

Short-falls or order errors should be registered within 3 days of receiving your order.

Unjustified returns are subject to our agreement and will entail a 15% handling fee.

Delivery information (times exclude holiday periods)

Delivery of goods purchased from AP Fitzpatrick to mainland UK addresses will normally be within 3 to 14 days, subject to availability.

In exceptional circumstances, if delivery is delayed AP Fitzpatrick will attempt to inform the customer.

We offer a full UK-wide mail order service by courier. Orders dispatched by courier are normally allocated a tracking number, which can be provided upon request. For UK Islands and Highlands addresses delivery will incur an additional cost.

Royal Mail may be used to dispatch small items, excluding hazardous, flammable, high value goods and large volumes of liquid.

All orders received by website or email are processed during our shop opening hours.

Large or bulky items can be delivered subject to quotation. Please contact us for more information.

Bespoke products and materials are subject to individual lead times and carriage costs.

For large Workshop-made Canvases being sent outside of London, we recommend customers arrange collection from our London shop, although we are happy to get quotations from a trusted independent art carrier for you. We suggest customers contact us before ordering to discuss delivery arrangements.  

Please contact us if you require more information on UK deliveries.

International delivery is made via courier, with calculation of delivery costs based on the weight of the order (up to 20kg) and the destination. This cost will be displayed when placing an order on our website.

For heavier orders please send your order by email, including your full address and contact details so that we can confirm the shipping costs. 

If a delivery cost is not displayed when placing an order, we will need to contact you once the order is placed to confirm the delivery cost, at which point you may choose to proceed or amend the order. 

Please note, certain items may not be available for international shipping.

Complaints

If you have any complaint regarding the services provided by AP Fitzpatrick, you should firstly email us at info@apfitzpatrick.co.uk and outline the details. Please address your email to Alan Fitzpatrick and include your contact details and telephone number. 

If your complaint is regarding a specific order placed through our shop, please also include your order number.

We will attempt to resolve any issues as soon as possible directly with you.

Our Rights

AP Fitzpatrick Fine Art Materials reserves the right to modify or withdraw any part of the website and any product listed with or without prior warning, temporarily or permanently.

If changes to the website or any products are made without prior notification to our customers, it is the responsibility of the customer to ensure that they are aware of such changes, and by continuing to purchase affected goods you are expressing your acceptance of these changes. 

AP Fitzpatrick reserves the right to contact customers in regards to any details relating to their order.

AP Fitzpatrick reserves the right to cancel orders.

If you do not agree to any changes to our terms and conditions then you must contact us before placing your order.

Back Orders and Special order items

If your item is not in stock, we will attempt to contact you. Your order may be delayed if we are expecting a delivery of the goods to our store. Alternatively, we may choose to send the out of stock item(s) when available, you can choose an alternate item or it can be removed from your order. Out of stock items will be charged for at the time of the submitting of the order (unlike telephone and postal orders). If the delay in supply deems the products in question to be no longer required, a refund or credit note can be issued, provided the goods are returned with original invoice as specified in our Refund Policy.

Some items listed on our website are marked as ‘special order’ items and such products are not held in our general stock. If you choose to purchase one of these items there is likely to be a delay on your whole order until the special order item has arrived from our suppliers. We will contact you to confirm after receiving your order and then contact to confirm arrival of the item before dispatch. 

Special order items are non-returnable and non-refundable.

If you are looking for an item produced by a manufacturer that supplies other products that are for sale on our website, please contact us as we may be able to supply the item to you as a special order.

VAT

Value Added Tax at a rate of 20% is added to all orders within the EU. 

VAT will be removed for customers ordering from outside of the EU.

Descriptions of Products

We will take all reasonable care to ensure that all Product details, descriptions and prices appearing on the Website are correct at the time of entry on to the website. Colour swatches displayed on the AP Fitzpatrick website will give a rough indication of the colour of the product listed, however no colour viewed online can be said to be totally accurate due to the variety of computer monitor and device display options available. The customer orders unfamiliar colours at their own risk, and the costs of any returns are the responsibility of the buyer if the actual colour received is not appropriate for the customer's requirements.

We always aim to keep the Website as up to date as possible, however the information including product descriptions appearing on this website at any given time may not always present the most current details when you place an order. We cannot confirm the price of a Product until your order is accepted by us. We reserve the right to alter prices at any time. In the unlikely event that a price has been entered incorrectly on the website our customer service team will contact you as soon as possible to inform you of the correct price. You are under no obligation to continue with the order at that point. If you wish to confirm any prices or product information prior to placing the order, please do contact us.

Our Website is powered by ekmPowershop, which has taken security measures to ensure that our customers are protected against loss, alteration or misuse of any data entered into our online shop.

When placing and paying for your order online, you will be taken to the ClearAccept payment gateway, where you will enter your credit or debit card details. The webpage for this is encrypted and all details entered are securely handled by ClearAccept. AP Fitzpatrick does not see or hold any credit card information for transactions completed online.

When making payment by Telephone, AP Fitzpatrick will take credit card details directly from the customer over the phone, only for the purpose of processing payment for orders. Credit card details are not retained once payment has been processed.

How we use cookies:
